The Website is operated by WALOO Digital LLC, a Wyoming limited liability company with its principal business address at 5830 East 2nd St. PMB 93789, Casper, WY 82609, United States ("WALOO", "we", "us", or "our").

Important distinction: Website terms vs. client engagements

These Terms govern the Website only. They do not replace a signed proposal, statement of work, master services agreement, or other contract that governs paid professional services. If you become a WALOO client, the terms of your engagement control the services we deliver, fees, deliverables, intellectual property, confidentiality, and project-specific obligations.

What the Website provides

The Website is an informational and commercial presence for WALOO's WordPress engineering, design, performance, and related professional services. It may include service descriptions, case studies, articles, contact forms, scheduling tools, and links to third-party resources. Limitation of liability

To the fullest extent permitted by law, WALOO and its members, managers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to your use of the Website, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, WALOO's total liability for any claim arising out of or relating to the Website or these Terms will not exceed one hundred U.S. dollars (USD $100) or the amount you paid WALOO specifically for Website-related services in the twelve (12) months before the event giving rise to the claim, whichever is greater.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless WALOO and its members, managers, employees, contractors, and affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Website, violation of these Terms, or violation of any third-party right.

Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Subject to the dispute resolution section below, the state and federal courts located in Wyoming shall have exclusive jurisdiction over disputes that are not subject to arbitration.

Dispute resolution

Most concerns can be resolved informally. Before initiating formal proceedings, please contact us at contact@waloo.co with a brief description of the issue. We will try to resolve it in good faith within sixty (60) days.

If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Website shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except that either party may seek injunctive relief in court to protect intellectual property or confidential information. Arbitration will take place in Wyoming unless the parties agree otherwise. The arbitrator's award may be entered in any court of competent jurisdiction.

Class action waiver. To the extent permitted by law, disputes must be brought on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date on this page. Material changes may be highlighted on the Website. Your continued use of the Website after changes become effective constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire agreement for Website use

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and WALOO regarding use of the Website and supersede prior understandings on that subject.
